EXCLUSION OF THE RIGHT OF WITHDRAWAL – PENALTY IN THE EVENT OF CANCELLATION OR EARLY DEPARTURE<\/strong><\/p>\nPursuant to Article 59 of Italian Legislative Decree of 6 September 2005 No. 206 \u201cConsumer Code\u201d, as amended, the applicability of withdrawal from the contract is excluded. Nevertheless, Albaresidence allows the Customer to cancel the reservation by midday (12 p.m.) on the day before arrival. After this time Albaresidence is entitled to apply, as compensation, the penalty of 100% of the total price of the reservation.<\/p>\n
In the event of early check-out, the management is entitled to request payment of the entire period booked, invoicing every night until the end of the reservation.<\/p>\n
6. <\/strong>START AND END OF STAY<\/strong><\/p>\nRooms in all facilities are normally available from 3 p.m. on the day of arrival and must be vacated by 10 a.m. on the day of departure. Any early check-in or late check-out after the indicated time is subject to a supplementary charge, to be confirmed by the establishment itself.\u00a0<\/p>\n
7. <\/strong>PREFERENCES AT THE TIME OF BOOKING<\/strong><\/p>\nAny room preferences indicated by customers (e.g.: ground floor, double beds, etc) are not binding on Albaresidence, which is entitled to choose whether or not to accept them depending on availability.\u00a0<\/p>\n
8. <\/strong>RIGHTS OF THE GUEST<\/strong><\/p>\nA guest whose reservation has been duly confirmed is entitled to the normal use of the premises of the establishment, made available to guests without specific conditions, and the normal service.\u00a0The guest may exercise his\/her rights in compliance with all the guidelines and regulations applicable to the establishment.<\/p>\n
9. <\/strong>OBLIGATIONS OF THE GUEST<\/strong><\/p>\nUpon arrival, the guest is required to pay the cost of his\/her stay in addition to the tourist tax.\u00a0The following payment methods are accepted: advance bank transfer, cash, debit card, credit card and electronic payments.<\/p>\n
10. <\/strong>OBLIGATIONS OF THE HOTEL<\/strong><\/p>\nAlbaresidence is required to provide the agreed facilities and services in a manner that is consistent with its standards.\u00a0The establishment may provide guests with adequate replacement accommodation (of the same quality) in the event of, for example, unusable room(s), extended stay of guests occupying the room in question, overbooking or other major hotel requirements requiring such a decision.\u00a0Any additional costs related to the replacement accommodation shall be borne by the hotel.<\/p>\n
11. <\/strong>LIABILITY FOR DAMAGE TO PROPERTY<\/strong><\/p>\nAlbaresidence shall be liable for any damage suffered by the guest if this occurred on the premises of the establishment and it or its employees are responsible for such damage.\u00a0<\/p>\n
The customer is responsible for damage to the structure of the establishment or to the furnishings. Any damage will be charged to the account of the customer who caused them. Under no circumstances may the furnishings in the rooms be moved without the permission of the management.<\/p>\n
Any missing items or linen shall be charged to the customer’s account. It is strictly forbidden to take out of the establishment the linen supplied to the rooms, since this is exclusively for use in the rooms.<\/p>\n
The management shall not be liable for any property kept in the rooms\u2019 safes or for any objects left in the rooms.<\/p>\n
12. <\/strong>MAINTENANCE<\/strong><\/p>\nAlbaresidence reserves the right to make changes to the organization and the establishment while it is open to the public. As part of the necessary maintenance activities, the customer shall agree, without any right to a refund, that works may be carried out to the accommodation or the establishment while he\/she is staying there.\u00a0<\/p>\n
<\/span>13. <\/strong><\/span>ANIMALS<\/strong><\/p>\nAnimals may not be brought into the establishment.<\/p>\n
14. <\/strong><\/span>EXTENSION OF STAY<\/strong><\/p>\nThe guest cannot insist on an extension to his\/her stay. Any extension must always be accepted by the establishment.\u00a0If the guest is unable to leave the apartment on the scheduled departure date due to extraordinary and unforeseeable circumstances (e.g. natural disasters, floods, strikes, etc.) that preclude all possible means of travelling, the accommodation contract will be automatically extended for as long as it is impossible to travel.\u00a0Albaresidence is entitled in such cases to charge at least the standard rate for the accommodation provided.<\/p>\n
15. TERMINATION OF CONTRACT \u2013 FORCE MAJEURE<\/strong><\/p>\nAlbaresidence may terminate the contract with immediate effect if the guest:<\/p>\n
\n- uses the premises in a manner that seriously damages the property or makes peaceful coexistence with other guests impossible, by behaving in an overbearing, disrespectful, scandalous or in any case inconsiderate manner or engages in acts or omissions with respect to the accommodation service provider, staff, other guests and\/or persons located in the Hotel that are punishable by law as a criminal offence, with respect to property rights, morality and the physical wellbeing of others.<\/li>\n
- has a contagious disease or a disease whose duration exceeds the agreed period of stay, or if special treatment is necessary<\/li>\n<\/ul>\n
If the performance of the contract is prevented due to force majeure events (e.g. natural disasters, strikes, lockouts, official orders, etc.), Albaresidence may terminate the contract at any time without prior notice, if the contract is not deemed to have already been terminated by operation of law, or if the establishment has not already been released from its obligation in this regard. Any right to claim compensation for any damage etc from Albaresidence Srl is excluded.<\/p>\n
16.<\/strong> COMPLAINTS<\/strong><\/p>\nIf a guest considers it necessary to make a complaint in relation to his\/her stay, the reasons must be notified in situ<\/em>, directly to the management of the establishment. Any guest who is not satisfied with the way in which his\/her complaint is handled has 8 days after check-out to file a written complaint, providing a detailed explanation of the reasons for the same.\u00a0<\/p>\n17.<\/strong> GOVERNING LAW AND JURISDICTION<\/strong><\/p>\nThese terms and conditions, as well as the relationship between users and Albaresidence, are governed by Italian law. The court for the place of residence or domicile of the customer, if located in Italian territory, shall have exclusive jurisdiction over any dispute that may arise between customers and Albaresidence Srl.<\/p>\n
